Less than 15 years of service — what you actually get

On a normal discharge below 15 years (PBOR), there is no monthly service pension — but there is a lump-sum service gratuity from 5 years up: half a month's last-drawn emoluments per completed six months of service. The exceptions that change everything are invalidment (monthly invalid pension can start from 10 years — sometimes even below) and a service-connected disability of 20%+, which pays a disability element even on top of a gratuity. Every rule below carries its regulation number from the Pension Regulations for the Army, 2008 (2020 corrected edition).
The baseline rule
- PBOR (sepoy to subedar major): minimum qualifying service for a service pension is 15 years (Regulation 47).
- Officers: minimum for a retiring pension is 20 years of actual qualifying service — 15 for a late entrant who reaches the compulsory retirement age with at least 15 but under 20 (Regulation 34 and its explanation).
Below the mark, normal discharge — the service gratuity
- Who: PBOR discharged on completing engagement, tenure, service limit or on compassionate grounds (Regulation 46), with 5 or more years of actual service but less than the 15 needed for pension (Regulation 54; the 5 years count without weightage).
- How much: "half a month's reckonable emoluments last drawn… for each completed 6 monthly period of qualifying service" (Regulation 55). Twelve years = 24 half-years = 12 months' emoluments, once.
- No cut for going early: the same regulation bars any reduction for those permitted premature discharge on compassionate grounds or personal reasons.
- Officers below 20 years: a retiring gratuity on the same half-month-per-six-months scale, minimum 10 years, ceiling ₹20 lakh w.e.f. 01.01.2016 (Regulations 39–40).
Invalided out — the exception that pays monthly
- 10 years or more: invalid pension is admissible (Regulation 59). Scale (Regulation 60): PBOR with 15+ years get service pension as under normal rules; 10–15 years get invalid pension at the service-element rate; officers 20+ get retiring pension, 10–20 the service-element rate.
- Below 10 years: invalid gratuity — again half a month's emoluments per completed six months (Regulation 60(b)). Recruits and boys get it at the lowest-group sepoy rate (Regulation 61).
- The 2019 liberalisation: for personnel in service on or after 04.01.2019, invalid pension is admissible even below 10 years where the invaliding disability — though neither attributable to nor aggravated by service — permanently incapacitates the person for military service and civil re-employment (MoD letter No. 12(06)/2019/D(Pen/Pol) dated 16.07.2020, recorded in Regulation 59).
- Low medical category discharge for want of a suitable appointment also qualifies for invalid pension/gratuity even where the disability is not service-connected (Regulation 58(b)).
Disability element — payable on top, even with a gratuity
Discharged on completion of engagement with a disability the Release Medical Board records as attributable to or aggravated by service, accepted at 20% or more? The disability element is granted "in addition to service pension or service gratuity" from the date of discharge (Regulation 53) — short service does not erase it. What short service does not take away — and what it does
- Still yours: retirement gratuity under its own rules (minimum 5 years — calculator), leave encashment, and AGIF maturity benefits.
- Lost with the pension: ECHS — the scheme's own eligibility rules say ex-servicemen not drawing a pension are not eligible. This is the costliest hidden consequence of leaving before the pension mark; weigh it before signing anything.
- Special cases exist: mass discharges under government policy carry a special pension/gratuity scale of their own (Regulation 56), and Territorial Army / DSC service has its own counting rules — ask your Record Office with your exact service record.

Questions and answers
Do I get a pension with less than 15 years of service?
Not a service pension (Regulation 47 sets 15 years for PBOR). A normal discharge with 5+ years earns a one-time service gratuity of half a month's last-drawn emoluments per completed six months (Regulations 54–55). Invalidment is the exception that can pay monthly.
How is service gratuity calculated?
Half a month's reckonable emoluments last drawn × completed six-month periods of qualifying service (Regulation 55) — with no reduction for compassionate/personal-reason discharge.
I was invalided out before 15 years — do I get a monthly pension?
With 10+ years, yes — invalid pension (Regulation 59–60). Below 10, normally invalid gratuity — but post-04.01.2019 cases invalided with a non-attributable disability that blocks both military and civil employment get invalid pension even below 10 years. A 20%+ service-connected disability adds the disability element on top.
What is the minimum service for an officer's pension?
20 years (15 for late entrants) for retiring pension; below that, a retiring gratuity from 10 years, capped at ₹20 lakh (Regulations 34, 39–40).
What else do I still get with a short service?
Retirement gratuity, leave encashment and AGIF benefits survive; ECHS does not, because it requires a pension. Agniveers follow their own scheme.
